New setback: the Uruguayan justice ratified the rejection of the refugee request of Fabián Rodríguez Simón
Fabian “Pepin” Rodriguez Simon suffered a new legal setback in Uruguay. The Court of Appeals of that country confirmed the ruling of Judge Adriana Chamsarián that rejected the request for political refuge of Mauricio Macri’s former adviseron whom an international arrest warrant weighs in the framework of a case in which he is being investigated for extortion of the owners of the Indalo Group during the Cambiemos government.
Rodríguez Simón has remained on Uruguayan soil since December 8, 2020 and the federal judge María Servini declared him in absentia on May 19, 2021after Rodríguez Simón himself announced through the media that he was in that country and that he did not intend to appear at the inquiry to which he had been summoned, something that his defense later ratified in writing.
In the ruling, as reproduced by the site The Daily of Uruguay, it is pointed out that the Court of Appeals stated that “it does not follow that the Judiciary of his country persecutes him and/or does not provide him with minimum guarantees to defend himself.” Only one judge maintained discrepancies with the majority vote, arguing that “in the case, the guarantees of due process were violated, in particular, the right of the refugee applicant to propose evidence was ignored, which determines the nullity of the sentence handed down.”
The ruling does not automatically trigger the extradition process, which is now in the hands of the Uruguayan justice system.
Rodríguez Simón is represented in Uruguay by the lawyer Jorge Diazformer Court Prosecutor and former Attorney General of the Nation of that country during the government of Tabaré Vázquez.
When he declared him in absentia, Judge Servini remarked that the former official “gave ample public evidence of his intention to withdraw from Justice, which was ratified by his defense attorney on May 18, 2021” and defined the strategy of requesting refuge politician in Uruguay as a delaying maneuver.
Servini stated that the macrista leader had full knowledge of the existence of the file since mid-2019 and was able to defend itself in that area with all the guarantees of the lawwhich is why it is impossible to understand the statement referring to his alleged fear of being unduly detained.
The Servini file investigates “the alleged existence of acts carried out by public officials, from the highest echelons of the National Executive Power or at the request of those, who through harassment and financial drowning of the Indalo Group companies, would have imported cases of corruption”, according to what emerges from the imputation that works in the case.
